Well if they both normally do not like each other when sober, and the one that remembered the sex is unhappy about it and with the other person, i would say jail time for somebody. Sex without permission, drunk or not, is illegal. The circumstances that got them to that point is probably of little interest to the courts and the only thing they will look at is somebody had sex without permission. I don't think the government really cares what the real situation is, and the true intentions of the person usually means nothing in court.

That is going to severely impact dating if a man cannot have sex with a woman who has been drinking.
Some people would never have gotten married without alcohol.
Many people would have never been born without alcohol.
And some women would never get laid without alcohol.

 

Yeah i would say that applies to both men and women. Some are so ugly it's pitiful, while some are such assholes no one can stand to be around them and so on. I bet that would be a good way to flush the gene pool...

 

And this is the part that sucks. The man would mostly be the one being charged, if there are any charges.

Here's a question;
What if the sex is consensual, but after, one or the other decides it was lousy sex; you know, the time when you thought it was going to be good, but then you realize this is lame but you can't think of a polite way to leave yet, cause you know, you're right in the middle of doing it, and just leaving would be, you know, rude. So you sort of finish up, and then you're getting dressed or whatever, and you decide that wasn't what you signed up for.

Then can you say you didn't consent? You know, you consented to good sex, not whatever that was.

I know this is the daily mail, but it is stories like this that make me angry. While modern feminists are busy playing the victim card at every opportunity, and claiming men have many more advantages than women. I should point out that it's a fact that the legal system penalises men to a much greater extent than women. It's a fact that women get the benefit of the doubt in all divorce cases. It's a fact you're more likely to be a victim of violent crime or murder if you are male. And that rape statistics indicate men are raped as often as women.

Any sexual contact without the explicit consent of BOTH parties should be considered RAPE. A drunk person cannot give reasonable consent.

The key word is consent; not willingness. If a woman doesn't want to have sex but agrees to do so anyway, that is not rape, unless the agreement is under duress. (I have no idea if that's the point he was trying to make.)

 

Women (probably men too) consent all the time when they don't want to have sex, I believe this is particularly true of married women. Rape is when the sex is not consensual, or when consent was obtained through violent or threatening (including blackmail) behaviour.
